In January 2009, defendant twice sold crack cocaine to an undercover officer working for the Broome County Sheriff's Department and, as a result, was indicted and charged with two counts of criminal sale of a controlled substance in the third degree. Following a jury trial, defendant was convicted as charged and thereafter was sentenced as a second felony offender to concurrent prison terms of five years followed by three years of postrelease supervision...
