The petitioner moves for an order pursuant to CPLR 2308 (b) compelling the respondent, Rodwell Rillen, DMV, to comply with a subpoena ad testificandum. The respondent opposes the instant application. For the reasons set forth herein, it is ordered that the petitioner's application is granted.
