Petitioner, a firefighter for respondent City of Binghamton, sustained a work-related injury in December 2007, as a result of which he applied for and was granted benefits pursuant to General Municipal Law § 207-a. In May 2009, petitioner was examined by a physician retained by the City and thereafter ordered to return to work or risk termination of his benefits.
