In January 2007, petitioner was convicted of the crimes of attempted criminal possession of a controlled substance in the third degree and criminal possession of a weapon in the third degree. He was sentenced to three years in prison followed by two years of postrelease supervision and a concurrent prison term of 2 to 4 years.
