OPINION OF THE COURT

JONES, J.

Defendant was indicted for murder and other charges stemming from a shooting at a Brooklyn dance club in which a woman was killed and a man, with whom she was dancing, was wounded. The People theorized that the male victim was the intended target and the female victim was accidentally killed by a bullet which struck her after passing through him.
