Defendants Jason Kennedy (Kennedy) and Kennedy Associates (KA) (collectively the moving defendants) move to dismiss the complaint on the basis of plaintiff's failure to timely serve the complaint pursuant to CPLR 306-b. Plaintiff opposes (motion sequence No. 005).
