In 2004, defendant was convicted of sexual abuse in the first degree and sentenced to six months in jail followed by 10 years of probation. In 2009, defendant admitted violating certain conditions of his probation and it was revoked. Consequently, on August 14, 2009, defendant was resentenced to 1½ to 4½ years in prison.
