THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. GEORGE W. TYLER, Appellant.

Decided September 30, 2010.


As a result of his conviction of driving while intoxicated as a felony, defendant was sentenced to 180 days in jail and five years of probation. He was subsequently charged with violating the conditions of his probation. Following a violation hearing, County Court revoked his probation and resentenced him to 1 1/3 to 4 years in prison on the original charge. Defendant now appeals.

Defendant's sole argument is that the sentence of imprisonment is harsh and excessive...
