Defendant Rockledge moves pursuant to CPLR 2221 seeking reargument of its motion for summary judgment which was partially denied by this court's decision dated September 23, 2009 (25 Misc.3d 1212[A], 2009 NY Slip Op 52042[U] [2009]).
