PEOPLE v. HILL

2009-00283.

74 A.D.3d 1092 (2010)

902 N.Y.S.2d 387

THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. TYRONE HILL, Appellant.

Appellate Division of the Supreme Court of New York, Second Department.

Decided June 15, 2010.

Ordered that the judgment is affirmed.

The record supports the hearing court's determination that the pretrial identification procedure was not unduly suggestive. Accordingly, the hearing court properly denied suppression of the identification testimony of the witness who identified the defendant during that procedure (see People v Chipp, 75 N.Y.2d 327, 335-336 [1990], cert denied 498 U.S. 833 [1990]).
