Ordered that the order is modified, on the law, by deleting the provision thereof, in effect, denying that branch of the plaintiffs' motion which was for summary judgment dismissing the first through sixth affirmative defenses asserted by the defendants estate of Harold D. Shapiro and Mark Shapiro and Karen Schwartz, as executors of the estate of Harold D. Shapiro, and substituting therefor a provision granting that branch of the motion; as so modified, the order is affirmed...
