The defendant is charged with three counts of unlawfully dealing with fireworks in violation of Penal Law § 270.00 (2) (a) (i), (ii) and (b) (i). Defendant moved, among other things, for suppression of approximately 8,000 pounds of fireworks on the grounds that they were seized without probable cause, and statements allegedly made to the arresting officers as the fruit of an unlawful arrest.
