Defendant, who was then 23 years old, allegedly had sexual intercourse with a 16 year old who was at his home to babysit his infant. He was charged in a four-count indictment, and eventually convicted by a jury of two of the charged counts, one count of rape in the third degree and one count of endangering the welfare of a child. Supreme Court sentenced him to 1 to 3 years in prison on the rape conviction and a concurrent one-year term for endangering...
