Ordered that the order is affirmed.

In 2002 the defendant pleaded guilty to criminal possession of a controlled substance in the second degree, a class A-II felony offense, and criminal possession of a weapon in the second degree, a class C violent felony offense. He was sentenced to a determinate term of imprisonment of 5 years on the weapon possession count and an indeterminate term of imprisonment of 8 1/3 years to life...
