The defendant was charged on December 10, 2007 with one count of petit larceny, a class A misdemeanor, in violation of Penal Law § 155.25. By notice of motion filed on May 19, 2008, the defendant through his attorney Mary M. Rhodes, Esq. moves for omnibus relief. The People have responded through the affirmation in opposition of Jasper Mills, III, Esq. filed on June 2, 2008. The matter now comes before the court...
