Defendant pleaded guilty to rape in the second degree and sodomy in the second degree and was sentenced to a prison term of 3 to 6 years based upon his admission that he had sex with the then 13-year-old victim on at least three separate occasions in January 2003. The Board of Examiners of Sex Offenders recommended that defendant be classified as a risk level three sex offender and, following a hearing, County Court adopted the Board's recommendation...
