Ordered that the judgment is modified, on the law, by deleting the provision thereof granting that branch of the petition which was to annul so much of the determination as imposed a water surcharge for the petitioner's failure to either install a water meter or request installation by June 30, 2000, and substituting therefor a provision denying that branch of the petition; as so modified, the judgment is affirmed, without costs...
