The motions bearing sequence numbers 002 and 003 are consolidated for decision.

In sequence number 002, defendants move to vacate that portion of his court's order dated May 14, 2007 and entered May 21 2007 which deemed defendant Timothy Lang to be in default and to permit him to file a late answer to the amended complaint.
