PEOPLE v. URIAS

2006-1207 Q CR.

2008 NY Slip Op 51484 (U)

THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. JOSE URIAS, Appellant.

Appellate Term of the Supreme Court of New York, Second Department.

Decided July 16, 2008.

Following a nonjury trial, defendant was convicted of attempted assault in the third degree (Penal Law §§ 110.00, 120.00 [1]) and harassment in the second degree (Penal Law § 240.26 [1]). Viewing the evidence in the light most favorable to the People (see People v. Contes, 60 N.Y.2d 620 [1983]), we conclude that it was legally sufficient to establish defendant's guilt of both offenses beyond a reasonable doubt.
