On December 7, 2005, plaintiff was a passenger in a pickup truck operated by defendant Albert Pine (hereinafter "Pine") and was injured when Pine's vehicle struck Defendant Jose Rosario's (hereinafter "Rosario") tractor trailer at the intersection of State Route 23 and State Route 9W in the Town of Catskill, New York.
