BOSSON, Justice.

{1} Kenneth Douglas was fatally shot in the back of the head while sitting in the driver's seat of a parked car outside the Atrium Club in Alamogordo, New Mexico. His cousin, Jason Carrell, was sitting beside him in the front passenger seat and ran from the car after hearing the shot. Carrell was then shot three times as he ran away but survived to call 911.
