Latney and his co-defendant Darrell Foote, also known as Darrell Smalls, were indicted and charged with robbery while armed with a deadly weapon, a crime of the first degree, N.J.S.A. 2C:15-1, and possession of an imitation firearm for an unlawful purpose, N.J.S.A. 2C:39-4(e).
