The petitioner, Lachlan MacLearn, and the intervenor, Simon Hutchings (together, the appellants), appeal an order of the Superior Court (Abramson, J.) denying Hutchings' motion for summary judgment and granting summary judgment in favor of the respondent, Commerce Insurance Company (Commerce).
