I. SUMMARY

The special prosecutor for Cass County charged the appellant, David W. Kofoed, with tampering with evidence, a Class IV felony. Kofoed was the supervisor of the Crime Scene Investigation Division for the Douglas County sheriff's office (CSI Division). The State charged that Kofoed falsified DNA evidence during the investigation of Matthew Livers and Nicholas Sampson as suspects in the April 2006 murders of Wayne and Sharmon Stock...
