Donna Benell (Donna), the guardian and conservator of Lester McMurry (Lester), brought an action to set aside a 2005 deed of a farm located in Logan County, Nebraska. In the deed, Lester reserved a life estate in the farm for himself and gave the farm to his longtime friend, Cheri Koinzan (Cheri), upon his death.
