On October 27, 2009, an information was filed in the district court for Butler County, Nebraska, charging Randy L. Mortensen with the offense of assault while being incarcerated, in violation of Neb.Rev.Stat. § 28-932 (Reissue 2008), and asserting that he was a habitual criminal. On October 25, 2010, Mortensen filed his motion for absolute discharge on the ground that his speedy trial rights had been violated under Neb.Rev.Stat. § 29-1208...
