INTRODUCTION

Brent Luff was convicted of and sentenced for attempted first degree sexual assault on a child. Luff filed a direct appeal, which we dismissed for failure to file a brief. Luff later filed a motion for new trial based on newly discovered evidence, and the trial court denied the motion. Luff filed a motion for postconviction relief alleging that his attorney was ineffective for failing to file a brief on appeal and requested reinstatement...
