A jury convicted Luis Carlos Vasquez-Arenivar of possession of a controlled substance with the intent to distribute and tampering with physical evidence. Following his sentencing, Vasquez-Arenivar appealed to this court alleging that the district court erred in denying his motion to suppress on the basis that he was subjected to an unconstitutional pat-down search for weapons.
