I. Procedural History and Factual Background

On 31 March 2008, Defendant was indicted on charges of possession with intent to sell and deliver cocaine and carrying a concealed weapon. On 23 May 2008, Defendant filed a motion to suppress the cocaine and weapon found during searches of Defendant and the vehicle in which Defendant was a passenger. Defendant's motion was heard on 16 July 2008 in Rutherford County Superior Court.
