¶ 1 Roland Tirey (Tirey) appeals from the 2009 Order of Revocation and Judgment of the Eleventh Judicial District Court, Flathead County.

¶ 2 We remand for further proceedings consistent with this opinion.

¶ 3 On appeal, Tirey raises the following issues:
