SCRUGGS v. STATE

No. 2011-CP-01260-COA.

102 So.3d 1172 (2012)

Ricky SCRUGGS a/k/a Rickey Scruggs, Appellant v. STATE of Mississippi, Appellee.

Court of Appeals of Mississippi.

Rehearing Denied September 4, 2012.

Certiorari Denied December 13, 2012.

Attorney(s) appearing for the Case

Ricky Scruggs, appellant, pro se.

Office of the Attorney General by Billy L. Gore , attorney for appellee.

Before LEE, C.J., ISHEE and FAIR, JJ.

FAIR, J., for the Court:

¶ 1. Ricky Scruggs pled guilty to murder. He later filed a motion for post-conviction relief, which the DeSoto County Circuit Court dismissed without an evidentiary hearing. Scruggs now appeals, contending the court erred in accepting his plea without a factual basis and without informing him of the elements of the crime. As we find both of these claims contradicted by the record, we affirm the circuit court's judgment.
