¶ 1. Late one evening in July 2001, Shenandoah Clark got behind the wheel of his friend's 2000 Toyota Tundra TRD truck (the truck) in Tupelo, Mississippi, to drive them to a casino out of town. While driving, Clark crashed the truck. Thereafter, Clark suffered severe spinal injuries, causing him to become a quadriplegic.
