¶ 1. On January 7, 2008, a Harrison County grand jury indicted Robert Jenkins for possession of a controlled substance, specifically, an amount of cocaine that was .1 gram or more but less than two grams in weight. Originally, Jenkins was indicted as a habitual offender pursuant to Mississippi Code Annotated section 99-19-81 (Rev.2007); however, the State later moved to amend the indictment to charge Jenkins as a habitual offender...
