¶ 1. On June 24, 2004, thirteen-year-old Brandon Wilson (Brandon) was injured in a swimming pool at a Hampton Inn Hotel (the Hotel) located in New Orleans, Louisiana. The Hotel was managed by defendant, Highpointe Hospitality (Highpointe), the president of which was Darryl LaPointe (LaPointe).
