DEPT. OF EMPLOYMENT SEC. v. SHIELDS

No. 2009-CC-01049-COA.

42 So.3d 1204 (2010)

MISSISSIPPI DEPARTMENT OF EMPLOYMENT SECURITY, Appellant v. Chandra SHIELDS, Appellee.

Court of Appeals of Mississippi.

August 10, 2010.

Attorney(s) appearing for the Case

Leanne Franklin Brady , attorney for appellant.

Chandra Shields , appellee, pro se.

Before KING, C.J., GRIFFIS and ISHEE, JJ.

GRIFFIS, J., for the Court:

¶ 1. The Mississippi Department of Employment Security ("MDES") appeals the judgment of the Humphreys County Circuit Court, which reversed the denial of unemployment benefits by the MDES Board of Review ("Board of Review"). MDES argues that the circuit court substituted its own judgment for that of the Board of Review when it found that there was insufficient evidence that Chandra Shields voluntarily abandoned her employment.
