¶ 1. On December 16, 2008, Robert E. Hicks filed a pro se motion to vacate and set aside his conviction of burglary of a dwelling house and sentence of twenty years in the custody of the Mississippi Department of Corrections (MDOC). The Tate County Circuit Court dismissed Hicks's motion without benefit of a hearing. Aggrieved, Hicks appeals.
