¶ 1. A jury sitting before the Amite County Circuit Court found Shelby Leroy Chisholm guilty of sexual battery. The circuit court sentenced Chisholm to thirty years in the custody of the Mississippi Department of Corrections. Aggrieved, Chisholm appeals and claims that the circuit court sentenced him to the maximum sentence for sexual battery to punish him for exercising his right to a trial instead of pleading guilty.
