Joe Louis AMERSON, Jr., Appellant v. STATE of Mississippi, Appellee.

Court of Appeals of Mississippi.

Rehearing Denied August 10, 2010.

Certiorari Denied November 10, 2010.

Attorney(s) appearing for the Case

Joe Louis Amerson Jr. , Appellant, pro se.

Office of the Attorney General by W. Glenn Watts , Jackson, attorney for appellee.

Before LEE, P.J., IRVING and BARNES, JJ.

IRVING, J., for the Court:

¶ 1. Joe Louis Amerson Jr., pro se, appeals the denial of his motion for post-conviction relief (PCR). Amerson asserts that the Circuit Court of Lauderdale County erred in finding his allegation of an illegal sentence to be time-barred pursuant to Mississippi Code Annotated section 99-39-5(2) (Supp.2009). Finding that Amerson untimely filed his PCR motion, we affirm the judgment of the circuit court.
