WALLER, CHIEF JUSTICE, for the Court.
¶ 1. This appeal arises from the conviction of David Brooks on two counts of aggravated assault arising from attempts to flee law enforcement officers. Brooks was sentenced to twenty years for each count, to be served consecutively. The initial appeal was decided by the Court of Appeals, which reversed Brooks's conviction and remanded the matter to the trial court for a new trial.
