This case comes before the Court from the order of the Circuit Court of Simpson County granting Donald Berry's and Hired Trucks, Inc.'s ("the Appellees") motions to dismiss the counterclaims made against them by Anthony Keyes in the Appellee's negligence suit filed against Keyes and his employer, Simpson County, Mississippi.1
