Theodore V. Kleine ("Appellant") was convicted following a jury trial and sentenced by the court on January 13, 2010, of two counts of first-degree murder that took place in 1970. Appellant claims the trial court erred in overruling his motion to dismiss the charges against him for lack of prosecution and that the trial court plainly erred in allowing Appellant's ex-wife to testify against him.
