WRIGHT, Judge.

In this appeal challenging the district court's decision to deny restitution to the family of the deceased victim of criminal vehicular homicide, the state argues that the district court erred by considering a prospective civil action arising from the offense in violation of Minn. Stat. § 611A.04 (2008). For the reasons set forth below, we reverse and remand to the district court.
