The Act at issue in the present case is Senate Bill 167, Chapter 191 of the 2011 Laws of Maryland (the "Maryland Dream Act" or "the Act"). The Act seeks to exempt certain students from paying out-of-state tuition rates at higher education institutions in Maryland. The Act was signed into law on May 10, 2011. Following the enactment, MDPetitions.com ("Appellee-Intervenor") petitioned to refer the Maryland Dream Act to Maryland's 2012 General Election ballot...
