KENNEY, J.

In 2008, Anthony McLean, appellee, applied for a renewal of a permit issued to him by appellant, Maryland State Police ("MSP") to carry a concealed weapon.1 MSP denied that application on the grounds that appellee had been convicted in 1983 of a misdemeanor that, at the time of the application for renewal, carried a maximum sentence of more than two years, thus disqualifying him, under Md. Code 2003, § 5-133(b)(1)
