In this case, we consider whether petitioner was prejudiced by the admission in his second trial of videotaped testimony by a deceased witness despite her statement to the police, unknown to petitioner during his initial trial, that she was "legally blind." We shall hold that the State failed to meet its discovery obligations under the Maryland rules, and that petitioner was prejudiced when the Circuit Court for Baltimore City received the witness's videotaped...
