In this case, Bank of America, N.A. ("the Bank"), added an individual's name to a checking account opened in the name of Melvin Ray Schultz ("Schultz"), the now-deceased father of Stephen Schultz ("Petitioner"). Petitioner sued the Bank, alleging that the Bank acted negligently and breached its contract with Schultz when it added the individual's name to, and allowed her to withdraw funds from, the account.
