Douglas Malarkey, appellant, a Takoma Park police officer, was charged with second-degree assault of John Courtney, in violation of Maryland Code (2002, 2008 Supp.), § 3-203 of the Criminal Law Article ("C.L."). As a result of the alleged assault, Courtney suffered a collapsed lung and three fractured ribs.
