The Commonwealth charged the defendant, Carl Sepheus, with possession of cocaine with the intent to distribute, G. L. c. 94C, § 32A(c). At the close of the Commonwealth's case in a jury-waived trial, Sepheus filed a motion for a required finding of not guilty, which the judge denied.
