After a jury found the defendant Laura Ryan guilty of larceny over $250, fraudulent use of a credit card, and identity fraud, a judge sitting without a jury adjudged her a common and notorious thief. See G. L. c. 266, § 40. On appeal, the defendant contends that (1) the evidence was insufficient to sustain a conviction of credit card fraud pursuant to G. L. c. 266, § 37C.
