McHUGH, J.

A mid-winter fire erupted in a house on Essex Avenue in Gloucester after an occupant threw a firecracker into a dry Christmas tree. The fire claimed the life of Ann Goyette, seriously injured Susan Anderson (Anderson), and inflicted lesser injuries on Clayton Enslow and Russell Currier.
